in the Metropolitan Region and the mining project &#8220;Pascua Lama&#8221; in Atacama, are just some of the best known examples of the current conflicts in force. <\/span><span class=\"goog-text-highlight\" style=\"vertical-align: inherit;\">According to the National Institute of Human Rights, at the date of this publication 117 conflicts of a socio-environmental nature are being promoted, of which 28% are related to mining and 38% to energy generation. <\/span>The Latin American reality is not different from what happens in our country, even the outlook is even worse, according to Amnesty International data, only in 2018 164 people died in the context of socio-environmental conflicts in Latin America and the Caribbean.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"vertical-align: inherit;\"><span class=\"goog-text-highlight\" style=\"vertical-align: inherit;\">What is the Escaz\u00fa Agreement?<\/span><\/span><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"vertical-align: inherit;\"><span class=\"goog-text-highlight\" style=\"vertical-align: inherit;\">The Escaz\u00fa Agreement began at the United Nations Conference on Sustainable Development (Rio + 20) in 2012, with the signing of the Declaration on the application of Principle 10 of the Rio Declaration on Environment and Development in Latin America and the Caribbean, the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean was adopted in Escaz\u00fa, Costa Rica on March 4, 2018, after two years of preparatory meetings (2012-2014) and nine meetings of the Negotiating Committee established in 2014 that had the significant participation of the public.<\/span><\/span><\/p>\n<p><span style=\"vertical-align: inherit;\">It consists of 26 articles, which in synthesis come to guarantee the full and effective implementation in Latin America and the Caribbean of:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\">The rights of access to environmental information.<\/span><\/span><\/li>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\"> Public participation in environmental decision-making processes.<\/span><\/span><\/li>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\"> Access to justice in environmental matters for its inhabitants.<\/span><\/span><\/li>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\"> The creation and strengthening of capacities and cooperation, contributing to the protection of the right of each person, of present and future generations, to live in a healthy environment and to sustainable development.<\/span><\/span><\/li>\n<li><span style=\"vertical-align: inherit;\">Defense of the human rights of environmental defenders.<\/span><\/li>\n<\/ol>\n<p><span style=\"vertical-align: inherit;\">This last point is contained in its article 9, it determines specific provisions for &#8220;Defenders of Human Rights in Environmental Matters&#8221;, obliging the signatory States to:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\"> Guarantee a safe environment for both natural persons and organizations that defend human rights in environmental matters.<\/span><\/span><\/li>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\"><span class=\"goog-text-highlight\" style=\"vertical-align: inherit;\"> Take adequate and effective measures to recognize, protect and promote all the rights of defenders of environmental human rights, including their life, personal integrity and their personal freedoms that may be unlawfully affected.<\/span><\/span><\/span><\/li>\n<li><span style=\"font-weight: 400;\"><span style=\"vertical-align: inherit;\"> Likewise, each State must take measures such as preventing, investigating and punishing attacks on defenders of environmental human rights in the exercise of the rights contemplated in the Agreement.<\/span><\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<div id=\"attachment_7843\" style=\"width: 1034px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-7843\" class=\"wp-image-7843 size-full\" src=\"https:\/\/glaciareschilenoss3.s3.us-west-1.amazonaws.com\/wp-content\/uploads\/2020\/08\/23211739\/macarena-1024x480-1.jpg\" alt=\"\" width=\"1024\" height=\"480\" \/><p id=\"caption-attachment-7843\" class=\"wp-caption-text\"><span style=\"vertical-align: inherit;\">Four years after the death of Macarena Vald\u00e9s, an activist from the Newen community of Tranguil, Panguipulli, in the Los R\u00edos region. <span class=\"goog-text-highlight\" style=\"vertical-align: inherit;\">Her body was found in strange circumstances on August 22, 2016. The investigation of her case is still open \/ \u00a9 El Desconcierto.<\/span><\/span><\/p><\/div>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"vertical-align: inherit;\"><span class=\"goog-text-highlight\" style=\"vertical-align: inherit;\">Chile has not yet adhered to the treaty, why?<\/span><\/span><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"vertical-align: inherit;\">Currently 22 countries have signed this International Treaty, of which 9 have ratified it, missing the signature of 2 nations for it to enter into force on September 26.
